Who We Are and What This Policy Covers

MAPLE BAY BUSINESS CAPITAL, LLC, a Delaware limited liability company (“Company,” “we,” “us,” or “our”), provides asset-based financing to middle market companies. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit maplebaybusinesscapital.com (the “Website”), contact us, or communicate with us about our services.

Our services are for businesses only. This policy applies to:

  • Business representatives: officers, employees, and advisors of companies that contact us or that we contact about potential financing;
  • Owners and guarantors: owners, members, partners, and guarantors of businesses, and sole proprietors, about whom we receive information in connection with a business financing inquiry; and
  • Website visitors generally.

We do not offer credit for personal, family, or household purposes, and the Website is not intended for consumers or for anyone under 18. If you are seeking personal credit, please do not submit information through the Website.

This policy does not cover information we collect in the course of a financing transaction under a separate application, agreement, or privacy notice. In that case, the terms provided to you at that time also apply.

Information We Collect

Information you provide to us. When you use our contact form, email us, or call us, we collect information such as your name, job title, company name, email address, phone number, and the contents of your message, which may include information about your business and its financing needs. If you provide information about other people, such as a business’s owners, you represent that you are authorized to do so.

Information collected automatically. When you visit the Website, we and our service providers automatically collect device and usage information, such as your IP address, browser type, operating system, device identifiers, referring and exit pages, pages viewed, time spent, and approximate location derived from your IP address. This is collected using cookies and similar technologies (see “Cookies, Analytics, and Similar Technologies” below).

Records of our communications. We keep records of emails and messages between you and us. If we intend to record a telephone call with you, we will tell you before the recording begins. If you do not want the call recorded, you may end the call or tell us you do not consent, and we will not record it.

Please do not send sensitive information. The contact form and unencrypted email are not designed to receive Social Security numbers, tax identification numbers, bank or card account numbers, government ID numbers, or confidential financial statements. We will tell you how to securely provide any information needed for underwriting if and when it is required.

Where We Get Information

We collect personal information from:

  • You, directly through the contact form, email, phone, and other communications;
  • Your device and browser, automatically, through cookies and similar technologies;
  • Your company and its representatives and advisors, if they contact us on your behalf; and
  • Third parties, if we pursue a financing opportunity, such as public records, credit reporting and business information providers, and other third parties. That information is handled under the applicable application, agreement, and notice at that time.

How We Use Information

We use personal information to:

  • respond to inquiries and communicate with you about our services;
  • evaluate and pursue potential financing opportunities;
  • send business-to-business marketing and updates about our services, where permitted (you can opt out at any time);
  • operate, maintain, secure, and improve the Website, including analytics and troubleshooting;
  • detect, prevent, and investigate fraud, security incidents, and unlawful activity;
  • comply with legal, regulatory, and contractual obligations, and enforce our rights and agreements; and
  • carry out other purposes that are described when we collect the information or that you consent to.

We do not use personal information collected through the Website for automated decision-making that produces legal or similarly significant effects.

How We Disclose Information

We may disclose personal information to:

  • Service providers that help us run our business, such as website hosting, analytics, customer relationship management, email, IT and security providers, and professional advisors (lawyers, accountants, auditors). They may use the information only to provide services to us.
  • Affiliates under common ownership or control with us.
  • Prospective and actual financing participants, such as co-lenders, participants, and referral partners, in connection with a potential or actual financing, as permitted by your agreements with us.
  • Successors, in connection with a merger, financing, acquisition, bankruptcy, or sale of all or part of our business or assets.
  • Authorities and others, where we believe disclosure is required by law, subpoena, or legal process, or is necessary to protect rights, property, or safety, or to investigate fraud.
  • Others with your consent or at your direction.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. See “Sale and Sharing” in the California section below.

De-identified and aggregated data. We may use de-identified or aggregated information, which cannot reasonably be used to identify you. If we do, we will maintain it in de-identified form and will not try to re-identify it.

Cookies, Analytics, and Similar Technologies

We use cookies, pixels, web beacons, and similar technologies to operate the Website and understand how it is used. Cookies are small data files placed on your device that let us remember your preferences and collect information about your usage. Pixels and web beacons are small graphic files that help us understand how visitors interact with the Website.

Analytics. We use Google Analytics to understand how visitors use the Website. Google acts as our service provider for this purpose. We have turned off Google Signals and other advertising features, we do not link Google Analytics to advertising accounts, and we do not use Google Analytics data for advertising. You can opt out using the Google Analytics Opt-out Browser Add-on.

Managing cookies. Our Cookie Policy explains the types of cookies we use and how to manage them, including through your browser settings.

Do Not Track. We do not respond to “Do Not Track” browser signals because there is no uniform standard for them.

Marketing Communications and Calls

With your consent where required, we may send you business-to-business emails about our services. Every marketing email includes an unsubscribe link. You can also opt out by emailing joe@maplebaybusinesscapital.com, and we will process your request within 10 business days. Opting out of marketing does not stop service-related or transactional messages about an inquiry or financing you have with us. We may call you at the number you provide in response to your inquiry.

How Long We Keep Information

We retain information you submit through the contact form, and other prospect and inquiry information, for up to 2 years after our last communication with you, unless you become a client or ask us to delete it sooner. You may request deletion at any time by contacting us at joe@maplebaybusinesscapital.com.

We retain website analytics and cookie data for up to 26 months. We retain other personal information only as long as reasonably necessary for the purposes described in this Privacy Policy, including to meet legal, accounting, and regulatory requirements, resolve disputes, prevent fraud, and enforce our agreements. We may keep information longer where required by law, legal process, or a legal hold. Information relating to a financing transaction is retained as described in the agreements and notices provided to you at that time and for the period required by applicable law. When information is no longer needed, we delete or de-identify it.

Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we become aware of a breach of your personal information, we will notify you and regulators as required by applicable law.

How to Exercise Your Rights

To submit a request, email us at joe@maplebaybusinesscapital.com or call 312-771-8933.

We must verify your identity before fulfilling requests to know, access, delete, or correct, by matching information you provide with information we hold. An authorized agent may submit a request on your behalf if you give them written permission, and we may ask you to verify your identity directly with us. We will confirm receipt within 10 business days and respond within 45 days, and we may extend that period once by an additional 45 days where reasonably necessary, and will tell you if we do. We may deny a request where permitted by law, for example where an exception applies, and will explain why.

Exemptions

The CCPA does not apply to certain information, including personal information subject to the Gramm-Leach-Bliley Act or the California Financial Information Privacy Act. If we determine that your request involves information covered by one of these exemptions, we will tell you in our response.

Other California Disclosures

Under California Civil Code Section 1798.83, California residents may request certain information about disclosure of personal information to third parties for their direct marketing purposes. We do not disclose personal information for third-party direct marketing. Contact us at joe@maplebaybusinesscapital.com with any questions.

Residents of Other States

Some states give residents rights regarding their personal information. Most of these laws do not apply to information collected from individuals acting in a commercial or business capacity, and many exempt financial institutions or certain financial data. If you live in a state that provides rights to access, correct, delete, or opt out of targeted advertising or sales of personal information and you believe these rights apply to you, you may submit a request at joe@maplebaybusinesscapital.com. We will tell you whether the right applies. If we deny your request, you may appeal by replying to our response, and we will respond within the period required by law.

Nevada. Nevada residents may opt out of the sale of certain personal information. We do not sell personal information. You may contact us at joe@maplebaybusinesscapital.com with questions.

Children

The Website is for businesses and is not directed to anyone under 18. We do not knowingly collect personal information from anyone under 18. If you believe we have, contact us at joe@maplebaybusinesscapital.com and we will delete it.

Location and Transfers

The Website is intended for visitors in the United States. If you access it from elsewhere, your information will be processed in the United States, which may have different data protection laws than your location.

The Website may link to third-party websites we do not control. Their privacy practices are their own, and we encourage you to read their policies.
